Terms of Service for Glowby

1. Agreement to Terms

Welcome to Glowby! These Terms of Service ("Terms") govern your access to and use of the Glowby mobile application (the "App") provided by SIA Digital Publisher ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Glowby is a personal development and goal-setting application that helps users create vision boards, set goals, track progress, and stay motivated through:

• Vision board creation and customization
• Goal setting and tracking
• Progress monitoring and analytics
• Reminder notifications
• Motivational content and insights

4. Eligibility

4.1 Age Requirement

You must be at least 16 years old to use Glowby. By using the App, you represent and warrant that you meet this age requirement.

4.2 Account Registration

You may be required to create an account to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

5. User Content and Ownership

5.1 Your Content

You retain all ownership rights to the content you create and upload to Glowby, including:

• Vision boards and images
• Goals and checkpoints
• Notes and personal reflections
• Any other user-generated content

5.2 License to Us

By uploading content to the App, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, display, and process your content to provide the App services
• Create backup copies for data recovery
• Use aggregated, anonymized data for analytics and improvement

This license terminates when you delete your content or account, except for:

• Content that has been shared with other users
• Aggregated, anonymized data
• Data retained for legal compliance

5.3 Content Restrictions

You agree not to upload, post, or share content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains hate speech, harassment, or threats
• Contains explicit, violent, or harmful material
• Promotes illegal activities
• Contains viruses or malicious code
• Violates anyone's privacy or publicity rights

5.4 Content Monitoring

We reserve the right (but have no obligation) to:

• Monitor and review user content
• Remove content that violates these Terms
• Suspend or terminate accounts that violate these Terms

6. Intellectual Property Rights

6.1 Our Property

The App and its original content, features, and functionality are owned by SIA Digital Publisher and are protected by international copyright, trademark, and other intellectual property laws.

This includes:

• App design, layout, and user interface
• Software code and algorithms
• Glowby name, logo, and branding
• Pre-loaded templates and content
• Documentation and materials

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device
• Use the App for personal, non-commercial purposes
• Access features according to your subscription level

You may not:

• Copy, modify, or create derivative works
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, sell, or sublicense the App
• Remove any copyright or proprietary notices
• Use the App for commercial purposes without permission

7. Subscriptions and Payments

7.1 Subscription Plans

Glowby may offer subscription plans with different features and pricing. Subscription details include:

• Monthly or annual billing cycles
• Automatic renewal unless cancelled
• Different feature tiers (Free, Premium, etc.)

7.2 Pricing

• Subscription prices are displayed in the App
• Prices may vary by region due to local currency and taxes
• We reserve the right to change prices with 30 days' notice
• Price changes do not affect existing subscriptions until renewal

7.3 Payment Processing

• Payments are processed through Apple App Store or Google Play Store
• Payment terms are subject to their respective payment policies
• We use RevenueCat for subscription management

7.4 Free Trials

• Free trial periods may be offered for new users
• You must cancel before the trial ends to avoid charges
• Only one free trial per user
• We reserve the right to determine trial eligibility

7.5 Billing and Renewal

• Subscriptions automatically renew at the end of each billing period
• Your payment method will be charged 24 hours before renewal
• Cancel anytime through App Store/Play Store settings
• Cancellation takes effect at the end of the current billing period

7.6 Refunds

• Refund requests must be submitted to Apple or Google
• We cannot directly process refunds for App Store/Play Store purchases
• Refund eligibility is determined by Apple/Google policies
• Contact us at ask@glowby.app for refund assistance

8. Acceptable Use Policy

You agree to use Glowby only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Harass, abuse, or harm others
• Transmit spam or unsolicited messages
• Collect or harvest user data without permission
• Interfere with or disrupt the App or servers
• Attempt unauthorized access to the App or systems
• Use automated tools to access the App (bots, scrapers)
• Bypass any security or access control measures
• Upload viruses or malicious code

8.2 Consequences

Violation of this policy may result in:

• Content removal
• Account suspension or termination
• Legal action if required
• Reporting to authorities for illegal activities

9. Third-Party Services and Links

9.1 Third-Party Integrations

Glowby integrates with third-party services including:

• Meta (Facebook) for analytics and advertising
• TikTok for analytics and advertising
• RevenueCat for subscription management
• Authentication providers
• Cloud storage services

Your use of these services is subject to their respective terms and privacy policies.

9.2 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for:

• The content or practices of third-party sites
• Any transactions with third parties
• Privacy policies of external sites

We recommend reviewing the terms and privacy policies of any third-party services you access.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Glowby, you consent to:

• Collection and processing of your data as described in the Privacy Policy
• Use of cookies and tracking technologies
• Data sharing with third-party services
• International data transfers

11.1 Our Responsibilities

• Using a strong password
• Backing up important content

11.3 No Guarantee

• Unauthorized access due to circumstances beyond our control
• Data loss due to device failure or user error
• Security breaches despite reasonable security measures

12. Account Termination

12.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in the App
• Contacting us at ask@glowby.app
• Uninstalling the App (does not delete your account)

Upon termination:

• Your access to the App will cease
• Your data will be deleted according to our retention policy
• Active subscriptions will be cancelled
• No refunds for unused subscription periods

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• We detect fraudulent or illegal activity
• Your account has been inactive for an extended period
• Required by law or legal process

13. Disclaimers and Warranties

13.2 No Professional Advice

Glowby is a personal development tool and does not provide:

• Medical or mental health advice
• Professional counseling or therapy
• Financial or investment advice
• Legal advice

14. Limitation of Liability

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the Republic of Latvia, without regard to conflict of law principles.

15.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts of Latvia for resolution of any disputes.

15.3 Informal Resolution

Before filing any formal legal action, you agree to contact us at ask@glowby.app to attempt informal resolution of the dispute.

16. Changes to Terms

16.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately upon posting in the App for minor changes
• 30 days after notice for material changes

16.2 Notification

We will notify you of material changes by:

• Displaying a notice in the App
• Sending an email to your registered address
• Updating the "Last Updated" date

16.3 Acceptance

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the App and terminate your account.
